Bret Gerard has a wide ranging litigation practice. His practice encompasses commercial, real estate, insurance and coverage litigation; real estate/construction matters, extraordinary remedies, Uniform Commercial Code matters and arbitration/mediation. His business litigation practice has a specific focus on real estate, partnership disputes, and high-dollar collections. He is also a trained mediator and has extensive experience in settling cases through the processes of mediation and arbitration. Bret is also fluent in Spanish.
Bret’s approach is to resolve claims quickly, through summary motion practice or other dispositive motion, if practicable. His familiarity with the judiciary makes him an ideal choice for helping steer national law firms and out-of-state counsel through the unique Texas judicial and arbitration systems. He has acted as Texas counsel for New York, Los Angeles, Miami, Omaha, Atlanta and Charlotte law firms who do not have a standing presence in Texas.
Bret has had an active trial practice for almost 30 years. His practice includes commercial litigation, construction litigation, and insurance litigation. He has also prosecuted and defended clients in trademark and copyright litigation matters.
Bret’s clients include real estate investment and development companies, property owners, retail companies, landlords, tenants, title insurance companies, real estate management companies, architects, engineers, hotel developers, construction companies, general contractors, subcontractors, construction material providers, construction equipment companies, insurance agents and brokers, major insurance companies and insureds. He is equally at home in the courtroom as he is in the boardroom and he understands that claims need to be resolved swiftly and economically.
Bret and his wife, Lori, have four children: a son who is a practicing attorney, a son in medical school at Texas Tech University Health Sciences Center, a daughter in graduate school at New York University and a daughter in her senior year of high school.
They enjoy walking and playing with their two dogs, Jade (a Labrador Retriever) and Ruby (a Golden Doodle). Bret is an avid tennis player who participates in USTA leagues. He also enjoys sports, an occasional game of golf and reading about both historical and current events.
Bret and his family enjoy travel. When they have the opportunity for extended travel, Paris and Rome are favorite destinations due to the historical significance of the two cities. Bret hopes to one day travel to Australia, New Zealand and the Orient.
